1. Introduction

Welcome to ClickDefender. These Terms of Service ("Terms") govern your access to and use of the ClickDefender website, services, and applications (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Service Description

ClickDefender provides a click fraud protection service for pay-per-click (PPC) advertising campaigns. Our Service includes:

  • A JavaScript tracking script for installation on your websites
  • Real-time click fraud detection and scoring
  • Dashboard for viewing analytics and fraud reports
  • IP blocklist generation compatible with Google Ads
  • API access for programmatic integration
  • Alerting and notification features

The Service is designed to identify potentially fraudulent clicks but cannot guarantee detection of all fraudulent activity or elimination of all invalid clicks. Click fraud detection involves probabilistic analysis, and some false positives or false negatives may occur.

3. Account Registration

To use the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete registration information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 18 years old and capable of forming a binding contract to create an account. We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion.

4. User Responsibilities

As a user of the Service, you are responsible for:

  • Correctly installing the tracking script on your websites
  • Ensuring you have the right to install tracking on websites you add to the Service
  • Maintaining appropriate privacy policies on your websites that disclose the use of fraud detection services
  • Complying with all applicable laws, including data protection regulations
  • Obtaining necessary consents from your website visitors where required by law
  • Reviewing and acting upon fraud reports and alerts

5. Acceptable Use Policy

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights
  • Commit or facilitate click fraud, ad fraud, or any form of advertising fraud
  • Interfere with or disrupt the integrity or performance of the Service
  • Attempt to gain unauthorized access to the Service or its related systems
  • Reverse engineer, decompile, or disassemble any aspect of the Service
  • Use the Service to collect data for purposes other than fraud detection
  • Resell, sublicense, or redistribute the Service without our written consent
  • Use the Service on websites that promote illegal activities, hate speech, or malware
  • Generate artificial traffic or clicks to manipulate the Service
  • Share your account credentials with unauthorized third parties

We reserve the right to suspend or terminate your account for violations of this Acceptable Use Policy.

6. Payment Terms

6.1 Subscription Plans

The Service is offered on a subscription basis with various plans (Starter, Pro, Enterprise). Plan features and pricing are displayed on our pricing page. We reserve the right to modify pricing with 30 days' notice to existing subscribers.

6.2 Free Trial

New accounts are eligible for a 7-day free trial. To start a trial, you must provide a valid payment method (credit or debit card). When you start a trial:

  • Card authorisation only - We verify your card is valid but do not charge any amount
  • No payment during trial - No payment will be taken unless you decide to continue after your trial period
  • Cancel anytime - You may cancel your trial at any time before it ends and you will not be charged
  • Automatic subscription - If you do not cancel before the trial ends, your subscription will begin and your first payment will be taken automatically

We reserve the right to modify or discontinue free trials at any time. Free trials are limited to one per customer.

6.3 Billing and Payment Processing

Payments are processed securely through Mollie, a payment service provider regulated in the European Union. By subscribing, you authorise us to charge your payment method on a recurring monthly basis. We accept:

  • Credit and debit cards (Visa, Mastercard, American Express)
  • SEPA Direct Debit (European bank accounts)
  • Local payment methods (iDEAL, Bancontact, and others depending on your location)

Your subscription will automatically renew each month until cancelled. You will receive an email receipt for each payment.

6.4 Cancellation

You may cancel your subscription at any time through your account dashboard. Upon cancellation:

  • If cancelling during a free trial, you will not be charged
  • If cancelling an active subscription, you will retain access until the end of your current billing period
  • No partial refunds are provided for the remaining days in a billing period

6.5 Refunds

We do not provide refunds for partial months of service or for any period where you had access to the Service. Refund requests for exceptional circumstances (such as accidental duplicate payments or service unavailability) will be considered on a case-by-case basis. 6.6 Failed Payments

If a payment fails, we will notify you by email and may retry the payment. If payment cannot be collected after multiple attempts, your account may be placed in a grace period during which you retain limited access. If payment is not resolved within the grace period, your subscription will be suspended.

6.7 Taxes

All prices displayed are exclusive of applicable taxes. You are responsible for paying any taxes associated with your use of the Service, including VAT where applicable. VAT will be added to your invoice where required by law.

7. Intellectual Property

The Service, including all content, features, and functionality, is owned by ClickDefender and is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. This license does not include the right to:

  • Modify or create derivative works of the Service
  • Use the Service for any purpose not expressly permitted
  • Remove any proprietary notices from the Service

You retain ownership of your data. By using the Service, you grant us a license to use your data solely for providing and improving the Service.

8. Confidentiality

Both parties agree to keep confidential any non-public information disclosed during the use of the Service. This includes your click data, fraud reports, and account information. We will not disclose your confidential information except as required by law or with your consent.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED
  • WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE
  • WE DO NOT GUARANTEE ANY SPECIFIC RESULTS FROM USING THE SERVICE
  • IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM
  • WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES

These limitations apply regardless of the theory of liability and even if we have been advised of the possibility of such damages. Some jurisdictions do not allow limitation of implied warranties or liability for certain damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless ClickDefender and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

11.1 Termination by You

You may cancel your subscription at any time through your account dashboard. Cancellation will take effect at the end of your current billing period. You may also request deletion of your account and data by contacting us.

11.2 Termination by Us

We may suspend or terminate your access to the Service immediately, without prior notice, if:

  • You breach these Terms
  • You fail to pay any fees when due
  • We are required to do so by law
  • We discontinue the Service (with 30 days' notice where possible)

11.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We will retain your data for 30 days following termination, after which it will be deleted. You may request an export of your data before termination.

12. Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time. We will provide reasonable notice of material changes. Your continued use of the Service after such changes constitutes acceptance of the modified Service.

13. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Before initiating any legal proceeding, you agree to attempt to resolve disputes informally by contacting us. We will attempt to resolve any dispute through good faith negotiations.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ClickDefender regarding the Service.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

15. Changes to These Terms

We may revise these Terms from time to time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. By continuing to use the Service after the changes take effect, you agree to the revised Terms.
